1. Acceptance of Terms

By accessing or using Mastering MOSS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Mastering MOSS is a Maritime Operator Safety System designed to help New Zealand maritime transport operators manage their safety compliance documentation, including MTOC forms, vessel records, crew certifications, and operational checklists.

3. Account Registration

To use the Service, you must:

  • Register for an account with accurate and complete information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorised access
  • Be at least 18 years of age or have parental consent

You are responsible for all activities that occur under your account.

4. Subscription and Payment
  • Free Trial: New accounts receive a 14-day free trial period
  • Billing: Subscription fees are billed monthly or annually in advance
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period
  • Refunds: Subscription fees are non-refundable except as required by law
  • Price Changes: We will provide 30 days notice of any price increases
5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share your account credentials with unauthorised persons
  • Attempt to gain unauthorised access to the Service or other accounts
  • Upload malicious code or interfere with the Service's operation
  • Use the Service to store or transmit false compliance information
6. Data Ownership

You retain ownership of all data you enter into the Service. By using the Service, you grant us a limited license to store, process, and display your data as necessary to provide the Service.

You may export your data at any time. Upon account termination, we will retain your data for a reasonable period to allow for export, after which it will be deleted.

7. Compliance Disclaimer
Important: While Mastering MOSS is designed to help you manage your maritime compliance documentation, it does not guarantee compliance with Maritime New Zealand regulations or any other regulatory requirements. You are solely responsible for ensuring your operations comply with all applicable laws and regulations. The Service is a tool to assist with documentation management, not a substitute for professional maritime safety advice.
8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice and may need to perform emergency maintenance without prior notice.

9. Limitation of Liability

To the maximum extent permitted by New Zealand law, Mastering MOSS and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, regulatory penalties, or business interruption.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Termination

We may suspend or terminate your account if you breach these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of New Zealand.
